This is subject to availability. You do this by contacting us by telephone. No rights can be derived from this.<\/li>\n<\/ul>\n<h3>Has your cruise been cancelled?<\/h3>\n<p>Unfortunately, it sometimes happens that a cruise cannot take place due to poor weather conditions or unforeseen circumstances. In such cases, we will do everything we can to inform you in a timely manner. It is therefore important that we have the correct details such as your telephone number and email address.<\/p>\n<p>In case of cancellation by us, the cruise will be rescheduled to a different date or time in consultation with you. If you wish, the ticket will be refunded.<\/p>\n<p>All sailings are subject to weather conditions; the skipper and the guide determine whether a cruise can take place.<\/p>\n<h3>Good to know<\/h3>\n<ul>\n<li>You are expected to check in at the sales kiosk 30 minutes before departure.<\/li>\n<li>The JORPANAVIC B.V. has a spacious saloon and upper deck, and there are toilets on board.<\/li>\n<li>Please dress appropriately for the weather conditions.<\/li>\n<li>There is a catering service on board, but you are also welcome to bring your own food or drinks.<\/li>\n<\/ul>\n<h3>Safety<\/h3>\n<p>A sailing ban applies in the following cases:<\/p>\n<ul>\n<li>Wind warning level 6 or higher at the coast<\/li>\n<li>See\u00a0<a href=\"https:\/\/www.knmi.nl\" target=\"_blank\" rel=\"noopener\">www.knmi.nl<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.buienradar.nl\" target=\"_blank\" rel=\"noopener\">www.buienradar.nl<\/a><\/li>\n<li>Cancellation by the management due to organisational or technical reasons<\/li>\n<\/ul>\n<h3>Privacy<\/h3>\n<p>We use your telephone number and email address for sending tickets or reservations, communicating cancellations, or for questions about a cruise.<\/p>\n<hr \/>\n<h2>Full Terms and Conditions<\/h2>\n<h3>Article 3 \u2013 Reservations and sailings<\/h3>\n<p><strong>3.1.<\/strong>\u00a0Regular sailings are cruises for which a reservation can be made by and for one or more persons. Reservations for regular cruises can be made for up to 32 persons. Reservations can be made via the internet or by telephone. Online reservations can be made up to 1 hour on the day prior to the sailing. Participation in a regular sailing is also possible by registering at the boat itself.<\/p>\n<p><strong>3.3.<\/strong>\u00a0Passengers (including groups) must be present 30 minutes before a cruise. If you are running late, please contact us by telephone.<\/p>\n<p><strong>3.4.<\/strong>\u00a0Pets are permitted on board provided they are kept on a leash.<\/p>\n<p><strong>3.5.<\/strong>\u00a0By order of the Shipping Inspectorate, smoking is prohibited on board the cruise boat.<\/p>\n<h3>Article 5 \u2013 Weather conditions and force majeure<\/h3>\n<p><strong>5.2.<\/strong>\u00a0Weather conditions that impede or render the cruise impossible shall apply as a condition for dissolution for all cruises. Whether such weather conditions exist is at the discretion of the skipper on duty. At wind force above 8 Beaufort, no sailing will take place. This does not preclude the skipper from deciding not to sail at a wind force below 8 Beaufort. In all cases of force majeure, the skipper on duty may decide not to carry out or to modify the sailing. Force majeure is any circumstance that prevents shortcomings from being attributed. And in case of insufficient participation.<\/p>\n<p><strong>5.3.<\/strong>\u00a0The skipper on duty is entitled to remove passengers from the vessel who behave inappropriately or are in an obvious state of intoxication.<\/p>\n<p><strong>5.4.<\/strong>\u00a0The client must follow all instructions of JORPANAVIC B.V. or its employees promptly and without delay.<\/p>\n<p><strong>5.5.<\/strong>\u00a0The skipper has the right to modify the sailing route when weather conditions or obstructions on the planned route require this.<\/p>\n<h3>Article 6 \u2013 Delays and waiting times<\/h3>\n<p><strong>6.1.<\/strong>\u00a0For regular sailings, the boat will not wait; it departs at the scheduled time.<\/p>\n<h3>Article 7 \u2013 Payment<\/h3>\n<p><strong>7.1.<\/strong>\u00a0Group sailings must be paid on the day itself, unless otherwise agreed.<\/p>\n<p><strong>7.2.<\/strong>\u00a0Regular sailings can be paid in advance, by card or in cash.<\/p>\n<p><strong>7.3.<\/strong>\u00a0Payments must be made to the bank account of JORPANAVIC B.V. upon receipt of the invoice.<\/p>\n<p><strong>7.4.<\/strong>\u00a0Amounts due must be paid in a single instalment.<\/p>\n<p><strong>7.6.<\/strong>\u00a0Any collection costs incurred shall be borne by the client.<\/p>\n<h3>Article 9 \u2013 Cancellation by the client<\/h3>\n<p><strong>9.1.<\/strong>\u00a0Cancellation can be made in writing, by telephone or by email, stating the date.<\/p>\n<p><strong>9.6.<\/strong>\u00a0At the request of the client to sail on a different day or time: you can request up to 2 hours before departure to reschedule your cruise to a different date or time. This is subject to availability. You do this exclusively by telephone and we will discuss on which day and time you wish to sail.<\/p>\n<h3>Article 11 \u2013 Liability of JORPANAVIC B.V.<\/h3>\n<p><strong>11.1.<\/strong>\u00a0JORPANAVIC B.V. is never liable for damage to and\/or loss of property of the client. The client takes all their belongings on board entirely at their own risk.<\/p>\n<p><strong>11.2.<\/strong>\u00a0JORPANAVIC B.V. is never liable for damage caused by death or injury of the client, except where caused by gross negligence or intent on the part of JORPANAVIC B.V.<\/p>\n<p><strong>11.3.<\/strong>\u00a0JORPANAVIC B.V. is never liable for damage to persons or property of the client arising from boarding the departure jetty or the cruise boat. The client boards the departure jetty and\/or the cruise boat entirely at their own risk.<\/p>\n<p><strong>11.4.<\/strong>\u00a0JORPANAVIC B.V. is never liable for damage caused by delays at departure or during the cruise.<\/p>\n<p><strong>11.5.<\/strong>\u00a0Insofar as JORPANAVIC B.V. is liable for any damage, it is only liable for direct damage and never for indirect (consequential) damage, and this liability is limited to the maximum amount covered by its insurance.<\/p>\n<p><strong>11.6.<\/strong>\u00a0Insofar as JORPANAVIC B.V. is liable for any damage not covered by its insurance, this liability is limited to a maximum of the invoice amount.<\/p>\n<p><strong>11.7.<\/strong>\u00a0JORPANAVIC B.V. is never liable for lost items of the client.<\/p>\n<h3>Article 12 \u2013 Liability of the client<\/h3>\n<p><strong>12.1.<\/strong>\u00a0The client is liable for damage caused by the client to property of JORPANAVIC B.V. or third parties.<\/p>\n<p><strong>12.2.<\/strong>\u00a0The client is liable for damage that the client or their luggage causes to JORPANAVIC B.V. or its employees.<\/p>\n<p><strong>12.3.<\/strong>\u00a0All activities organised and carried out by JORPANAVIC B.V. take place entirely at the risk of the client.<\/p>\n<p><strong>12.4.<\/strong>\u00a0The client indemnifies JORPANAVIC B.V. against damage claims by third parties.<\/p>\n<h3>Article 13 \u2013 General liability<\/h3>\n<p><strong>13.1.<\/strong>\u00a0JORPANAVIC B.V. is not liable for personal injury or damage of any kind, regardless of the cause, prior to, during or as a result of the sailing. The exception to this is the legal obligation to compensate for damages caused by demonstrable intent or gross negligence. The legal compensation is limited to a maximum of the amount paid.<\/p>\n<p><strong>13.2.<\/strong>\u00a0Children are the responsibility of their parents\/supervisors. Children aged 14 or younger must at all times be accompanied during the sailing.<\/p>\n<p><strong>13.3.<\/strong>\u00a0If JORPANAVIC B.V. is unable to carry out the cruise as agreed due to force majeure (see article 5.2), JORPANAVIC B.V. is not obliged to provide any refund.<\/p>\n<h3>Article 14 \u2013 Complaints<\/h3>\n<p><strong>14.1.<\/strong>\u00a0Any complaints must be submitted in writing (email) to JORPANAVIC B.V. no later than 2 days after the cruise.<\/p>\n<p><strong>14.2.<\/strong>\u00a0Complaints made verbally or later than 2 days after the cruise will not be considered.<\/p>\n<h3>Article 16 \u2013 Safety<\/h3>\n<p><strong>16.1.<\/strong>\u00a0The client must at all times follow the instructions of the skipper and\/or guide.<\/p>\n<p><strong>16.2.<\/strong>\u00a0If instructions are not followed, the skipper on duty or employees of JORPANAVIC B.V. have the right to terminate the sailing. The client cannot claim any reduction of the amount stated in the agreement.<\/p>\n<p><strong>16.4.<\/strong>\u00a0If more persons than previously indicated wish to join a group sailing, the skipper may refuse the surplus if the maximum permitted number of passengers on the boat is exceeded.<\/p>\n<h3>Article 17 \u2013 Found\/lost items<\/h3>\n<p><strong>17.1.<\/strong>\u00a0Found items can be handed in to the guide or skipper on duty.<\/p>\n<p><strong>17.2.<\/strong>\u00a0JORPANAVIC B.V. will make every effort to trace the rightful owner of the found item. Found items will be kept by JORPANAVIC B.V. for a maximum of one month.<\/p>\n<p><strong>17.3.<\/strong>\u00a0If the owner of a found item comes forward, they may collect the item from JORPANAVIC B.V. In all cases, the owner must provide identification.<\/p>\n<h3>Article 18 \u2013 Applicable law and competent court<\/h3>\n<p><strong>18.1.<\/strong>\u00a0These terms and conditions and all agreements concluded under these terms and conditions are exclusively governed by Dutch law.<\/p>\n<p><strong>18.2.<\/strong>\u00a0Any disputes arising from these terms and conditions and agreements concluded under these terms and conditions shall be exclusively submitted to the competent court in the district of Alkmaar.<\/p>\n<hr \/>\n<h2>Appendix: Additional sales conditions and information<\/h2>\n<h3>Ticket sales<\/h3>\n<p>You can purchase tickets at the counter or online via our website.
